The following is a binding commitment between the purchaser Kelly Kasper and Copperstone-Neverland
Neverland has gone to great lengths to raise
top quality
With regard to health replacement guarantee, Neverland
-upon OFA/OVC documented proof of moderate to severe hip/elbow dysplasia (i.e.
where lifestyle or mobility is greatly affected), for 2 years from birth,
or on ACVO/CERF proof of the eye disease
To effect our Guarantee and prior to any replacement, it is understood that the
owner(s) have adhered to recommended diet, maintenance and will provide to the
breeder a copy of the vet's report if available at the 18 month and 2, 3
and 5 yr mark to monitor full medical history. In the event a claim is
issued, reports from date of purchase to action are required from your attending
Veterinarian(s). We expect to receive updates with pictures. Please take
note of the importance of environment and diet in relation to the growth
of a young dog.
We insist that you keep pup on the foods (s)he has
been on while in our care- TLC- for at least a year. This nutrition
ensures that muscle development will not supersede skeletal formation putting
unreasonable stress on the dog's systems and frame, promoting a healthy soft
and shiny coat and excellent overall tone and condition. To be clear, if this
is not adhered to, we cannot continue to guarantee the above mentioned items as
advised from the first interview.
Neverland has agreed to sell you the above
Labrador Retriever under the following added commitments:
A) The dog will NEVER be allowed to run at large when unattended by you, his
owner(s) either on home property or elsewhere. Leash-free parks are not
recommended because though you may be certain of your dog's level of
assertiveness and vaccination, this cannot be said for
random dogs that may be encountered while off-lead. Loose animals can cause
injury to themselves, and due to fear resulting from unfamiliar surroundings
and people, possibly to others. Please avoid possible tragedy.
B) The dog will always be given adequate water, food, shelter, veterinary care
including up to date vaccines, and loving attention to ensure he/she is both
happy and healthy.
C) The dog will NEVER be kicked, severely handled (including shock collars,
pinch collars) or otherwise abused. It will not be subject to any other
environmental issues that may lead to harm of joints, bones, muscle or
tissue. D)
This puppy is being purchased on a legally binding non-breeding agreement
joined with this contract. Should you breed said dog/bitch (by accident or by
design) without Neverland Labradors written consent
you are liable for damages reasonably calculated as lost by Neverland
– the only party permitted to breed Neverland dogs-
including but not limited to the value of their average puppy price multiplied
by number in resulting litter, and potential legal action should it be found
that said breeding and subsequent litter was of detriment to the health and
welfare of said dog/bitch.
E) If the dog is being purchased for breeding purposes, the non-breeding
contract will be released ONLY when the following conditions have been met:
1. dogs
eyes are certified/rated normal by ACVO with CERF 2.
dogs hips & elbows are certified/rated normal with
OVC/OFA
3. dog has obtained his/her CAN or
AM Show Championship or Titled in either CD (Companion Dog Cert.) or
WC (Working Certificate) or JH (Junior Hunt) 4. Adequate
facilities to raise a litter (if female dog)
5. Neverland’s approval and selection of
breeding partner
6. Said dog to be of sound temperament and type 7. All puppies to be C.K.C or A.K.C.
registered and placed on non-breeding agreements.
*Neverland reserves final
right to approve or disprove release of non-breeding agreement.
It is strongly
recommended by Neverland however that all pet dogs be
sexually altered not before 12 and not later than 48 months. Neutering or Spaying too early can result in health problems, not the
least of which, early incontinence.
F) If a time arises that you are unable to keep the dog for whatever reason
(move, allergies, etc.) please notify Neverland,
the breeder immediately. Neverland reserves the right
of first refusal; if Neverland decides to adopt back
said dog/bitch, Neverland may allow a partial
pro-rated refund (percentage of purchase price based on age) of fees.
Alternatively, Neverland will take great effort in
placing your dog in a new approved loving home. Kennel Club Certificate of
Registration must be signed over and must be returned at time of dog’s return.
It may not be given/sold/transferred to anyone else without the
breeder's written consent.
G) The dog may never be released to any humane society, pound, research facility,
etc.
H) The dog may never be put down for any reason without Neverland’s
written permission. The only exception is an actual medical emergency
that requires an immediate decision. This doesn't include broken legs or
other injuries that could be repaired. If an emergency does occur where
life and death decision is required,
please notify Neverland in writing including
medical reports. If you are unable to do so, have
your Veterinarian send Neverland the report.
Failure to abide by any part of this
contract will cause the approved owners to be liable for up to $1200.00, (twelve
hundred dollars), above and beyond specific monetary penalty imposed on an
individual clause hereto laid out, and Neverland may reclaim the
dog and find a new, suitable home for said dog dependent on severity of clause
breached in an effort to always put first the
welfare of pups Neverland has produced.
This contract is in effect for the dog's entire life. With Buyer’s signature the Buyer swears that
he/she has answered truthfully all questions posed when being considered for
pup adoption by Neverland and is committed
to acting in the best interests of the animal in question.
